Welcome to "Not A Concierge." Our platform is designed to foster meaningful connections between concierges or agencies and users seeking their services. By using our platform, you accept these terms in full.


1. Definitions


Service: Refers to every aspect, both tangible and intangible, of "Not A Concierge."
User: This encompasses all individuals and entities, including both service providers and clients, using our platform.
Content: This includes, but isn't limited to, text, images, videos, designs, graphics, and all other forms of data.


2. Account Responsibilities


a. Registration: Users are required to provide true, accurate, and complete registration information.
b. Account Security: Users are accountable for maintaining the confidentiality of their account details. Any losses or damages resulting from not maintaining this confidentiality are not the responsibility of "Not A Concierge."
c. Content Responsibility: Users assume all responsibility for the content they produce. They should ensure no violation of rights, laws, or community standards.
d. Account Integrity: Users must not impersonate any other individual or entity, and should maintain the integrity of their account by ensuring accurate representation.
e. Notification of Breaches: Users should promptly notify us if they suspect any unauthorized activity in their account.


3. Limitation of Liability


a. General: "Not A Concierge" is not liable for any damages (direct, indirect, consequential) resulting from the use, misuse, or inability to use our platform.
b. User Interactions: We merely act as a facilitative platform and aren’t accountable for transactions or interactions between users.
c. Third-party Interactions: We don't endorse or verify third-party content or services that may be available through our platform.
d. Service Accessibility: We disclaim responsibility for periods where the service may be unavailable due to technical issues or maintenance.
e. Loss of Data: We're not responsible for any data loss, damage, or corruption resulting from the use of our platform.


4. Indemnification


Users agree to hold "Not A Concierge" harmless against claims, damages, liabilities, or costs arising from their misuse of the platform, violation of these terms, or infringement of any rights.


5. Service Integrity and Use


a. Misuse: Users should refrain from malicious activities that undermine our platform's integrity or security.
b. Content Standards: Posting illegal, harmful, obscene, or offensive content is strictly prohibited.
c. Respect: Users must adhere to principles of respect and decency in their interactions.
d. Automated Interactions: Using bots, scripts, or any automated method to interact with our platform without express permission is prohibited.
e. Service Modifications: Users should not modify, rent, lease, loan, sell, distribute, or create derivative works based on our service.


6. Termination


a. Voluntary Termination: Users can deactivate or terminate their accounts at their discretion.
b. Involuntary Termination: "Not A Concierge" retains the right to suspend or terminate user accounts for violations, suspicious activities, or any threat to the platform's integrity.
c. Effects of Termination: Upon termination, the user may lose access to their account, content, and any related data. Some residual data might remain for administrative purposes.


7. Intellectual Property


All content related to our platform, excluding user-generated content, is proprietary to "Not A Concierge." Unauthorized reproduction, distribution, or use is strictly prohibited.


8. Dispute Resolution


a. Arbitration: Before legal recourse, parties agree to settle disputes through binding arbitration in Texas.
b. Governing Law: These terms are governed by the laws of Texas, excluding its conflicts of law rules.


9. Updates to Terms


"Not A Concierge" reserves the right to modify these terms at any time. It is the user's responsibility to review these terms periodically for changes.


10. Feedback and Reports


Feedback is crucial for our growth. Users are encouraged to provide feedback, report bugs, or highlight any suspicious activities.


11. Confidentiality


a. User Information: All personal information provided by users is treated as confidential, in accordance with our Privacy Policy.
b. Platform Data: Any data or proprietary information related to our platform’s operations is considered confidential. Unauthorized dissemination is prohibited.


12. Warranties & Representations


All services are provided "as is." "Not A Concierge" disclaims any warranties, whether express or implied, including but not limited to fitness for a particular purpose, accuracy, or availability.


13. Miscellaneous


If any part of these terms is deemed unenforceable, the remaining portions will remain in full effect.
